Harmonizing State Privacy Laws
The Agency for Health Care Administration (Agency) was awarded a contract to participate in the national Health Information Security and Privacy Collaboration (HISPC) in May of 2006. This award resulted in a series of structured collaborative meetings around Florida and the publication of a series of reports and analysis of Florida laws which are available at:

Previous findings from the project highlighted the barriers to health information exchange and the need for the harmonizing of laws to provide greater consistency in standards. During 2007, Florida completed an analysis of laws related to health information exchange and the Florida HISPC Legal Work Group issued recommendations for legislation to facilitate health information exchange. The Florida project issued a comprehensive report, Analysis of Florida Statutes Related to Health Information Exchange.
In 2008, Florida will work in coordination with the Harmonizing State Privacy Law (HSPL) Collaboration with the goal of harmonizing state laws to facilitate health information exchange within and across state borders. Other states participating in the HSPL Collaboration are Kansas, Kentucky, New Mexico, Michigan, Missouri, and Texas.
As an active member of the HSPL collaboration, the Florida project will:
- Contribute to the inventory of existing materials that identifies or analyzes the health privacy laws within that state;
- Extend Florida’s previous analysis by populating a template that provides a uniform means of analysis of state laws by general taxonomy or areas of law;
- Identify laws for reform using the ranking methodology developed by the states participating in the Collaborative;
- Conduct education and outreach to Florida’s health policy leadership;
- Identify components of legislation needed to enable health information exchange; and
- Produce a toolkit and roadmap, to provide guidance to other states undertaking similar initiatives.
